TERMS & CONDITIONS, DIGITAL PRODUCT LICENSE & REFUND POLICY

PLEASE READ THESE TERMS & CONDITIONS CAREFULLY BEFORE USING THIS WEBSITE, PURCHASING A PRODUCT, OR ACCESSING BCMNG LLC CONTENT.
These Terms & Conditions, Digital Product License & Refund Policy (“Terms”) govern your use of websites operated by BCMNG LLC (“BCMNG,” “Company,” “we,” “us,” or “our”), including bcmngllc.com, as well as your purchase of and access to BCMNG courses, presets, downloads, educational materials, videos, photographs, graphics, written materials, digital products, and related content (collectively, “BCMNG Content”).
By checking the acceptance box at checkout and completing a purchase, you acknowledge that you have had the opportunity to review these Terms and agree to be legally bound by them.
If you do not agree to these Terms, do not complete your purchase or access BCMNG Content.
1. ELIGIBILITY AND ACCEPTANCE
By purchasing or accessing BCMNG Content, you represent that you have the legal capacity to enter into this agreement.
If you are under the age of majority in your jurisdiction, a parent or legal guardian must make the purchase and agree to these Terms on your behalf.
Your affirmative selection of the required acceptance checkbox at checkout constitutes your electronic acceptance of these Terms. Your electronic acceptance has the same effect as accepting a written agreement.
BCMNG may maintain electronic records relating to your acceptance and purchase, including the date and time of purchase and other transaction information.
2. DIGITAL PRODUCTS AND COURSE ACCESS
BCMNG offers educational courses, photography instruction, presets, downloadable resources, videos, written materials, and other digital products.
The specific materials included with your purchase are those identified on the applicable sales or checkout page at the time of purchase.
Purchasing BCMNG Content does not transfer ownership of that Content to you.
Instead, subject to these Terms, BCMNG grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the BCMNG Content you purchased solely for your own personal, non-commercial use.
Except where BCMNG expressly provides a downloadable file for your personal use, no BCMNG Content may be downloaded, copied, reproduced, republished, uploaded, posted, transmitted, distributed, sold, licensed, or otherwise exploited without BCMNG's prior written permission.
3. INTELLECTUAL PROPERTY
All BCMNG Content, including but not limited to:
course videos; lesson materials; photographs; graphics; designs; logos; branding; text; worksheets; guides; PDFs; downloads; presets; editing techniques and educational materials; course organization and presentation; audio; and other original materials,
is owned by or licensed to BCMNG LLC and is protected by applicable intellectual-property laws.
Your purchase provides permission to use the purchased Content as permitted by these Terms. It does not give you ownership of BCMNG's intellectual property.
All rights not expressly granted to you are reserved by BCMNG LLC.
4. PROHIBITED COPYING, RECORDING AND DISTRIBUTION
Unless BCMNG gives you prior written permission, you may not:
screen-record course videos or lessons;
record course audio or video using another device;
systematically screenshot lessons or materials;
copy or substantially reproduce course text, scripts, worksheets, guides, or other materials;
transcribe or reproduce substantial portions of BCMNG Content;
upload BCMNG Content to another website, course platform, social-media account, file-sharing service, cloud folder, artificial-intelligence system, database, or other platform for redistribution, publication, model training, or commercial exploitation;
share downloadable materials or presets with individuals who did not purchase them;
sell, sublicense, rent, distribute, give away, or otherwise transfer BCMNG Content;
remove copyright, trademark, branding, watermark, or proprietary notices; or
assist another person in doing any of the above.
Reasonable screenshots or excerpts taken solely for your own personal reference are permitted unless otherwise stated.
5. NO ACCOUNT OR LOGIN SHARING
Course access is licensed to the individual purchaser.
You may not share your username, password, login credentials, course account, or access link with another person.
You may not purchase one enrollment for use by multiple individuals unless BCMNG expressly offers a multi-user or business license.
BCMNG may restrict, suspend, or terminate access if it reasonably believes an account is being shared, distributed, exploited, or otherwise used in violation of these Terms.
6. PRESETS AND DOWNLOADABLE PRODUCTS
Any BCMNG presets, downloadable files, templates, guides, or similar digital products are licensed for the purchaser's personal use unless a different license is expressly stated at the time of purchase.
You may use BCMNG presets to edit your own photographs, including photographs you create for clients as part of your photography services.
However, you may not share, sell, redistribute, sublicense, upload, reproduce, or otherwise provide the preset files themselves to another person or business.
You may not modify a BCMNG preset or digital file and then distribute or sell the modified file as your own product.
7. EDUCATIONAL USE AND RESULTS DISCLAIMER
BCMNG Content is provided for educational and informational purposes.
Photography and editing involve individual judgment, creativity, equipment, lighting, environment, experience, and other variables. Results will differ from person to person.
BCMNG does not guarantee that purchasing or using its Content will produce any particular photographic result, business result, financial result, audience growth, client acquisition, income, or other outcome.
Examples, demonstrations, photographs, testimonials, or results shown by BCMNG are illustrative and are not guarantees that you will achieve the same or similar results.
You remain responsible for how you apply the information and techniques taught through BCMNG.
8. CUSTOMER PHOTOGRAPHS AND CONTENT
You retain ownership of photographs and other original content that you create.
Purchasing a BCMNG course or product does not, by itself, grant BCMNG permission to publicly use your photographs, name, likeness, testimonials, or other customer-created content for advertising or promotional purposes.
If BCMNG wishes to feature customer photographs, testimonials, or other customer-created materials for marketing purposes, any additional permission or license will be obtained separately where appropriate.
9. PAYMENT
You agree to pay the price displayed at checkout at the time of purchase, together with any applicable taxes or other disclosed charges.
You agree to provide accurate billing and payment information and authorize the applicable payment processor to charge the payment method you provide.
Prices, promotions, bundles, discounts, and product offerings may change at any time.
A later price reduction, sale, discount, or promotional offer does not entitle a previous purchaser to a refund or price adjustment.
10. DIGITAL PRODUCT REFUND POLICY
Unless otherwise expressly stated on the applicable sales page, all sales of BCMNG digital products, downloadable products, presets, and online courses are final once access or delivery has been provided.
Because digital products can be accessed, viewed, copied, downloaded, or otherwise consumed immediately after delivery, BCMNG generally does not offer refunds based on change of mind, failure to use the product, dissatisfaction with personal results, or a later promotional price.
However, if you:
are charged more than once for the same transaction;
purchase a product but BCMNG is unable to provide the purchased access or file; or
experience a verified technical problem originating with BCMNG that prevents access and BCMNG cannot reasonably resolve it,
please contact BCMNG.
Where appropriate, BCMNG may provide replacement access, technical assistance, or a refund.
Nothing in this section is intended to eliminate any refund, cancellation, or other right that cannot legally be waived under applicable law.
11. CHARGEBACKS AND PAYMENT DISPUTES
If you believe there is an error with your purchase, please contact BCMNG so that we have an opportunity to investigate and resolve the issue.
Nothing in these Terms prevents you from exercising legitimate rights available through your card issuer, payment provider, or applicable law.
However, knowingly initiating a fraudulent or materially false payment dispute or chargeback may result in suspension or termination of access to BCMNG Content and BCMNG may provide relevant transaction, access, and acceptance records to the applicable payment processor or financial institution in responding to the dispute.
12. THIRD-PARTY SERVICES
BCMNG may rely on third-party providers to operate portions of its business, including website hosting, course delivery, email services, payment processing, video hosting, analytics, and other technology services.
BCMNG is not responsible for outages, interruptions, failures, delays, security incidents, or other problems caused solely by third-party services outside BCMNG's reasonable control.
When reasonably possible, BCMNG will attempt to restore or provide alternative access to purchased Content affected by a technical issue.
Your use of certain third-party services may also be subject to the terms and privacy policies of those providers.
13. AVAILABILITY AND CHANGES TO CONTENT
BCMNG may update, improve, reorganize, replace, or discontinue portions of its website, courses, or digital offerings from time to time.
BCMNG does not guarantee that its website or digital services will operate uninterrupted or error-free at all times.
For purchased course access, BCMNG will provide access for the period represented to you at the time of purchase.
If BCMNG permanently discontinues a purchased course or materially changes the availability of previously purchased Content, BCMNG will handle access consistent with the access-duration or closure policy disclosed with that product and applicable law.
14. ACCEPTABLE USE
You agree not to use BCMNG's website, products, services, or Content:
for unlawful purposes;
to infringe BCMNG's or another person's intellectual-property rights;
to attempt unauthorized access to accounts, systems, or restricted Content;
to circumvent technological restrictions or access controls;
to interfere with the operation or security of BCMNG's website or services;
to scrape, harvest, systematically extract, or reproduce BCMNG Content for redistribution or commercial exploitation; or
to impersonate another purchaser or misrepresent your authorization to access BCMNG Content.
15. TERMINATION OF ACCESS
BCMNG may suspend or terminate your access to BCMNG Content if BCMNG reasonably determines that you have materially violated these Terms, including through unauthorized account sharing, copying, redistribution, resale, or commercial exploitation of BCMNG Content.
When appropriate, BCMNG may provide notice and an opportunity to correct a violation before terminating access.
Serious intellectual-property violations, fraud, unauthorized redistribution, or conduct that threatens BCMNG's systems or other users may result in immediate suspension or termination.
Termination of access does not transfer any ownership rights to you or authorize continued use or distribution of BCMNG Content.
16. COPYRIGHT AND INTELLECTUAL-PROPERTY VIOLATIONS
BCMNG respects the intellectual-property rights of others.
If you believe material appearing on a BCMNG website or service infringes intellectual property that you own or are authorized to represent, please contact BCMNG with sufficient information to identify the work, the allegedly infringing material, and your contact information.
BCMNG may investigate and remove or restrict access to material when appropriate.
17. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BCMNG CONTENT, WEBSITES, PRODUCTS, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, EXCEPT FOR WARRANTIES THAT CANNOT LEGALLY BE DISCLAIMED.
BCMNG DOES NOT WARRANT THAT ITS WEBSITE, COURSE PLATFORM, CONTENT, DOWNLOADS, OR OTHER SERVICES WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FREE FROM TECHNICAL DEFECTS.
BCMNG DOES NOT WARRANT OR GUARANTEE ANY PARTICULAR RESULT FROM THE USE OF ITS EDUCATIONAL MATERIALS.
18. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, BCMNG LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, BCMNG CONTENT, PRODUCTS, WEBSITES, OR SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, BCMNG'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO BCMNG FOR THE PRODUCT GIVING RISE TO THE CLAIM.
These limitations do not apply where liability cannot legally be excluded or limited.
19. INDEMNIFICATION
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless BCMNG LLC and its members, officers, employees, contractors, and agents from third-party claims, liabilities, damages, losses, and reasonable costs and expenses arising from or relating to:
your material breach of these Terms;
your unlawful use of BCMNG Content;
your infringement or violation of another person's intellectual-property or other legal rights; or
content that you submit or distribute through BCMNG's services in violation of applicable law or these Terms.
BCMNG reserves the right to participate in or assume control of the defense of a covered claim where reasonably necessary.
20. ELECTRONIC COMMUNICATIONS
By making a purchase or creating an account, you agree that BCMNG may provide transactional communications electronically, including purchase confirmations, receipts, account information, access instructions, updates concerning purchased products, changes affecting your account, and legal notices where electronic delivery is permitted.
Marketing and promotional communications will be handled separately in accordance with applicable law and your communication preferences.
21. PRIVACY
Your use of BCMNG websites and services is also subject to BCMNG's Privacy Policy.
The Privacy Policy explains how BCMNG collects, uses, stores, and otherwise handles personal information.
Where the Privacy Policy and these Terms address different subjects, each applies to its respective subject matter.
22. GOVERNING LAW AND VENUE
These Terms and any dispute arising from or relating to them will be governed by the laws of the State of Florida, without regard to conflict-of-law principles.
To the extent permitted by applicable law, any legal proceeding arising from these Terms shall be brought in an appropriate state or federal court located in the Florida county in which BCMNG LLC maintains its principal place of business, and the parties consent to jurisdiction and venue there.
Nothing in this provision eliminates rights that applicable consumer law requires to be available in another jurisdiction.
23. SEVERABILITY
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will remain in full force and effect.
24. NO WAIVER
BCMNG's failure to enforce a provision of these Terms on one occasion does not waive BCMNG's right to enforce that provision or any other provision in the future.
25. ENTIRE AGREEMENT
These Terms, together with the applicable checkout or sales page, Privacy Policy where applicable, and any additional written terms expressly associated with your purchase, constitute the agreement between you and BCMNG concerning that purchase and your use of the applicable BCMNG Content.
If product-specific written terms expressly conflict with these general Terms, the product-specific terms will control with respect to that product.
26. CHANGES TO THESE TERMS
BCMNG may update these Terms from time to time to reflect changes in its products, services, business practices, or legal requirements.
The current version will be posted on BCMNG's website with an updated effective date.
Unless required by law or expressly agreed otherwise, a material change to these Terms will not retroactively alter the material purchase terms applicable to a transaction you already completed.
Continued use of BCMNG's website or future purchases after updated Terms become effective may be subject to the updated Terms.
